Terms of Service

Rules and guidelines for using OstomyRN

Effective: March 16, 2026

1. Acceptance of Terms

By downloading, installing, accessing, or using the OstomyRN mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and OstomyRN, LLC ("OstomyRN," "we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the App following any changes constitutes acceptance of those changes.

2. Description of Service

OstomyRN is a free-to-download mobile application designed to support ostomy patients by providing:

  • Nurse Finder: A directory that helps users locate qualified Wound, Ostomy, and Continence (WOC) nurses in their area. The App deep-links to external provider systems to facilitate connections.
  • Education Library: Curated educational content related to ostomy care, lifestyle management, and wellness.
  • AI Assistant (Roxy): An artificial intelligence-powered chat assistant that provides general ostomy care information, guidance, and support with source citations.
  • In-App Purchases: Optional consumable message packs that provide additional AI chat messages beyond the free tier.

OstomyRN is manufacturer-neutral and is not affiliated with, endorsed by, or sponsored by any ostomy product manufacturer.

3. Medical Disclaimer

OstomyRN is NOT a medical device, is NOT a substitute for professional medical advice, diagnosis, or treatment, and should NEVER be used as such.

The information provided through the App, including content in the education library and responses from the AI assistant, is intended for general informational and educational purposes only. This information does not constitute medical advice and should not be relied upon as a basis for making health-related decisions.

You should always:

  • Consult with a qualified healthcare professional before making any decisions about your ostomy care or health.
  • Seek immediate medical attention for any medical emergencies.
  • Not disregard or delay seeking professional medical advice because of information obtained through the App.
  • Not use the App as a replacement for regular consultations with your healthcare team.

OstomyRN, LLC assumes no responsibility for any health outcomes resulting from the use of information provided through the App.

4. AI Assistant Disclaimer

Roxy, the AI-powered assistant within OstomyRN, is designed to provide general ostomy care information and emotional support. Roxy is not a licensed healthcare provider and cannot:

  • Diagnose medical conditions
  • Prescribe treatments or medications
  • Provide personalized medical advice
  • Replace the judgment of a qualified healthcare professional

While Roxy strives to provide accurate information with source citations, AI-generated responses may occasionally contain errors or outdated information. Roxy will always encourage you to consult with a healthcare professional for medical concerns.

You acknowledge that any reliance on information provided by Roxy is at your own risk.

5. User Accounts and Authentication

To access certain features of the App, you must create an account. Authentication is handled through a secure, passwordless email-based system powered by Auth0. By creating an account, you agree to:

  • Provide accurate and current information during registration.
  • Maintain the security of your account credentials and email access.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately at support@ostomyrn.com if you suspect unauthorized access to your account.

You must be at least 18 years of age to create an account and use the App. We reserve the right to suspend or terminate accounts that violate these Terms.

6. In-App Purchases

OstomyRN is free to download and includes a limited number of AI chat messages at no cost. Additional messages may be purchased through in-app purchases:

  • Message Packs: Consumable packs of additional AI chat messages (e.g., 50 messages for $0.99) are available for purchase within the App.
  • Processing: All in-app purchases are processed through Apple's In-App Purchase system (Apple IAP) on iOS devices. Purchases are charged to your Apple ID account.
  • Consumable Nature: Message packs are consumable. Once purchased messages are used, they cannot be restored or recovered.
  • No Subscriptions: OstomyRN does not currently offer subscription-based purchases. All purchases are one-time consumable transactions.

6.1 Refunds

All in-app purchases are processed by Apple. Refund requests must be submitted directly to Apple through their standard refund process. OstomyRN, LLC does not process refunds for in-app purchases. For assistance, visit reportaproblem.apple.com.

6.2 Pricing

Prices for in-app purchases are displayed in the App and may vary by region. We reserve the right to change pricing at any time. Price changes will not affect previously completed purchases.

7. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Notably, OstomyRN does not store Protected Health Information (PHI) on its servers. The App is designed with a privacy-first approach to protect your sensitive health-related information.

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of OstomyRN, LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

The OstomyRN name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of OstomyRN, LLC. You may not use such marks without our prior written permission.

The Roxy character, including all associated artwork, personality design, and conversational content, is the intellectual property of OstomyRN, LLC.

9. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works based on the App.
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the App.
  • Use the App to transmit harmful, offensive, abusive, or objectionable content.
  • Attempt to gain unauthorized access to any portion of the App, other accounts, or any systems or networks connected to the App.
  • Use automated scripts, bots, or other means to interact with the App or extract data from it.
  • Interfere with or disrupt the integrity or performance of the App or its related systems.
  • Misrepresent your identity or affiliation with any person or entity.
  • Use the AI assistant to generate content that is harmful, misleading, or intended to cause harm to others.

10. Third-Party Services and Links

The App may contain links to or integrations with third-party websites, services, and applications, including but not limited to:

  • External nurse and healthcare provider directories and scheduling systems
  • Authentication services (Auth0)
  • Payment processing (Apple In-App Purchase)
  • Educational resources and references

These third-party services are not under the control of OstomyRN, LLC, and we are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party service before using it.

The inclusion of links or integrations does not imply endorsement, sponsorship, or recommendation by OstomyRN, LLC.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

OstomyRN, LLC does not warrant that:

  • The App will be uninterrupted, timely, secure, or error-free.
  • The information provided through the App will be accurate, complete, or current.
  • Any defects in the App will be corrected.
  • The App will be compatible with all devices or operating systems.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OSTOMYRN, LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the App.
  • Any information or content obtained through the App, including responses from the AI assistant.
  • Any health-related decisions made based on information provided through the App.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct or content accessed through the App.

IN NO EVENT SHALL OSTOMYRN, LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO OSTOMYRN, LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless OstomyRN, LLC, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any health-related decisions or actions you take based on information obtained through the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination:

  • Your right to use the App will immediately cease.
  • Any unused purchased message credits may be forfeited.
  • Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitation of liability, and indemnification.

You may terminate your account at any time by contacting us at support@ostomyrn.com.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which OstomyRN, LLC is organized, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts of competent jurisdiction in the state in which OstomyRN, LLC is organized.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OstomyRN, LLC regarding the use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective" date at the top of this page and, where appropriate, notify you through the App or via email.

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
